MEDIATION:
Wrongful Death & Catastrophic Personal Injury
Hours before the case was scheduled to begin its final arbitration hearing, Todd was asked by the arbitrator to conduct a last-ditch mediation in a case that appeared impossible to settle. Plaintiffs, the widow and surviving adult children of a man in his late 50s who had died of electrocution while working on the electrical components of some heavy machinery at his work, sued his former employer for gross negligence and punitive damages. Starting in the early afternoon, Todd worked tirelessly until late into the night to get the case settled. Complicated family dynamics and difficult factual and legal issues presented challenges to getting the case resolved, but perseverance ultimately prevailed and the case was finally settled after midnight.
