CONSULTING: Commercial Litigation

Retained as part of a team of consultants early in the discovery phase of a partnership dispute with over $100 million at stake, Todd led early case jury research in the form of a focus group tailored to identify likely juror reaction to key thematic elements, shape deposition discovery, and evaluate potential challenges and tactical solutions to them.  He also engaged directly with the trial team on preparation for the key witness's deposition testimony by delivering witness communication training based both on the unique needs of the witness and the lessons learned from the focus group.  Following the conclusion of discovery, the consulting team conducted a full mock trial study of the case to assess and adjust trial presentation plans in the lead-up to trial.
